Dharwad: In a landmark judgment that has sent shockwaves across Karnataka, the Special Court of People’s Representatives has sentenced Vinay Kulkarni and 15 others to life imprisonment in the 2016 murder case of BJP leader Yogesh Gowda.


The verdict, delivered by Special Judge Santosh Gajanan Bhat, comes nearly a decade after the brutal killing, marking a decisive turn in one of the state’s most politically sensitive cases.


16 Convicted, Key Accused Get Life Sentence

The court convicted 19 accused in total, out of which 16, including Vinay Kulkarni, have been awarded life imprisonment. Another accused, Channakeshava Tingarikar, has been sentenced to 7 years in prison, while A1 Basavaraj Muthagi has been treated as a pardon witness.


The court also directed payment of Rs. 16 lakh compensation to the children of Yogesh Gowda, acknowledging the gravity of the crime.


Immediate Disqualification from MLA Seat

Following the conviction, Vinay Kulkarni stands disqualified as an MLA under the Representation of the People Act, 1951.


As per Section 8(3) of the Act, any elected representative sentenced to two years or more in prison loses their seat immediately. This position was reinforced by the landmark Supreme Court ruling in the Lily Thomas vs Union of India, which removed any grace period for appeal.


With this, the Dharwad Assembly constituency is now effectively vacant, and a by-election is expected within six months.


Background: A Murder That Shook Karnataka Politics

The case dates back to June 15, 2016, when Yogesh Gowda, a former Zilla Panchayat member, was brutally hacked to death inside a gym in Dharwad.


Initially investigated by local police, the case was handed over to the Central Bureau of Investigation (CBI) in 2019 following demands from the victim’s family.

The CBI later described the killing as a politically motivated murder, leading to the arrest of Vinay Kulkarni in November 2020 and filing of a chargesheet against 21 accused.

Legal Options Narrow, Political Future Uncertain

With a life sentence in place, Kulkarni faces severe legal and political consequences. Not only has he lost his MLA seat, but he is also barred from contesting elections for at least six years after completion of his sentence, unless a higher court intervenes.

Legal experts point out that only a stay on conviction, not just sentence, can restore his electoral eligibility and political status.

Courtroom Developments and Jail Directions

In a minor but notable development, Kulkarni’s lawyer sought permission for him to change clothes after remaining in the same attire for three days. The court directed jail authorities to provide clothing as per prison norms.
